Parent of a British / Settled Child

A Parent of a British Child visa allows a parent to live in the UK for 30 months (2.5 years) if they have sole responsibility for, or regular in-person access to, a child under the age of 18 who is either a British citizen or settled in the UK. Applicants must also meet the English language and financial requirements and show that they play an active and genuine role in their child’s life.

The Parent of a British or Settled Child Visa allows a parent who does not have the right to live in the UK to remain here based on their relationship with a child who is a British citizen or settled in the UK.

This is a family-based immigration route designed to protect the right of children to maintain a relationship with both parents. It reflects the UK’s obligations under Article 8 of the European Convention on Human Rights.

To qualify, you must be the natural or adoptive parent of a child who is under 18, is British or settled in the UK, and lives in the UK. You must also show that you are taking an active role in the child’s upbringing and that you have direct access — meaning you are not the primary carer.

If you are the child’s primary carer, a different route — the Zambrano or Derivative Rights route — may be more appropriate. Our team can advise you on which category applies to your circumstances.

The financial requirements are important. You must demonstrate that you can adequately maintain yourself and any dependants without recourse to public funds, unless you are exempt. Accommodation requirements must also be satisfied.

A successful application initially grants 30 months’ leave to remain, with the possibility of further extensions. After a total continuous period of 10 years, you may be eligible for indefinite leave to remain.
