Declarations & Affidavits

A declaration or affidavit is a formal written statement of fact, sworn or affirmed before a person authorised to administer oaths — such as a solicitor. It is used in legal proceedings, immigration applications, and various official processes where a formal, sworn statement is required.

An affidavit is a sworn document, meaning the person making it (the deponent) swears — either on a religious text or by solemn affirmation — that the contents are true to the best of their knowledge and belief. Making a false affidavit is a serious matter and can constitute perjury.

A statutory declaration is a slightly different form of sworn statement, made under the Statutory Declarations Act 1835. It is used in a wide range of official and non-official contexts, including confirming a change of name, verifying facts for professional bodies, and making declarations in connection with probate.

Common situations in which declarations or affidavits are needed include immigration and visa applications, confirming identity where documents are unavailable, property and land registration matters, and confirming changes to personal information such as a new name or change of address.
