EU Settlement Scheme

You may be able to apply for an EU Settlement Scheme Family Permit to come to the UK if you are a family member of a citizen from the EU, Switzerland, Norway, Iceland, or Liechtenstein, or a family member of an eligible person from Northern Ireland. This permit allows you to travel to the UK and join your family members. Applications must be made from outside the UK.

The EU Settlement Scheme (EUSS) was established to protect the rights of EU, EEA, and Swiss citizens who were living in the UK before 31 December 2020. The deadline for most applicants was 30 June 2021, but the scheme remains open for late applications in certain circumstances.

Successful applicants receive either Settled Status (if they had been living in the UK for at least five years continuously) or Pre-Settled Status (for those with less than five years of residence). Pre-Settled Status is valid for five years and allows you to continue building up the residence required for Settled Status.

Late applications are still being accepted where there are reasonable grounds for missing the original deadline. The Home Office considers a wide range of circumstances, including illness, domestic abuse, difficulties obtaining documents, and lack of awareness of the requirement.

Family members of EU citizens — including non-EEA national family members — may also be eligible to apply under the EUSS in certain situations, particularly if they were resident before the deadline or if they are joining an EU citizen who already holds Settled or Pre-Settled Status.

Those with Pre-Settled Status must ensure they apply for Settled Status before their current leave expires, and they must not be absent from the UK for more than five years during that period. The rules are detailed and specific; seeking legal advice is strongly recommended.
