Returning Residents

If you previously held Indefinite Leave to Remain (ILR) in the UK but have lived abroad for a significant period, you may have lost that status. ILR lapses if you remain outside the UK for more than two continuous years.

However, if you have strong ties to the UK, it may still be possible for you to return as a Returning Resident. This requires you to apply for a Returning Resident Visa at a UK Visa Application Centre in the country where you are currently residing.

To be eligible, you must show that you previously held ILR or settled status, that you had a genuine intention to return to the UK at the time you left, and that you have not lived permanently in another country in a way that suggests you have abandoned your UK settled status.

Factors that the Home Office will consider include the length of time you have been abroad, the reasons for your absence, your ties to the UK such as family members and property, and whether you have remained closely connected to the UK during your absence.

These applications are assessed on a case-by-case basis, and the strength of your evidence is crucial. Supporting documentation such as evidence of ties to the UK, reasons for prolonged absence, and bank or financial records can all support your application.
